Special obligations

Reports on special obligations used to be prepared as part of the annual reports on the SOE activities. However, following the changes in the regulatory framework concerning special obligations, it is planned to publish the information on special obligations separately from the annual report, starting with the annual report on the SOE activities 2018.

According to the Minister of Economy and Innovation in 2013 December 20 by order no. 4-1100 “Regarding the establishment of special obligations of state-owned enterprises and approval of information submission recommendations”, the functions of state-owned enterprises are considered special obligations when they meet the criteria for special obligations specified in the order and this compliance is officially coordinated with the Public Enterprise “Monitoring and Forecasting Agency”. The minister’s order specifies the criteria for compliance of the function with the special obligation:

1. The obligation to perform a certain clearly defined function is established in laws or resolutions of the Government of the Republic of Lithuania;
2. The function meets at least one of the following criteria:
   • state budget allocations are allocated to perform the function;
   • the performance of the function is financed with the funds of the European Union and/or other funds.
   • the costs of performing the function are covered by the income of other activities carried out by SOEs;
   • the pricing related to the performance of the function is regulated by laws, the Government of the Republic of Lithuania or its authorized institution, and the profit margin is not included in the determined price of the product or service or is limited in such a way that it does not allow covering opportunity costs;
   • performance of the function is a function of public administration.

Based on up to 2019 March 29 based on the official reasoned requests received from the institutions representing the state regarding the assignment of the functions performed by SOEs subordinate to these institutions to special obligations, the VKC compiled a list of special obligations. Based on the analysis of the functions performed by SOEs carried out by VKC, more functions performed by SOEs than are currently included in the list should be considered as special obligations, so the list will be filled and updated after receiving additional requests from institutions regarding the assignment of functions of SOEs managed by them to special obligations.

Good Governance Index

The SOE Good Corporate Governance Index (the Index) has been compiled since 2012. But the Index evaluation report was introduced as an independent document from the annual report on the state-owned enterprise (SOE) activities in 2016.

The SOE Good Corporate Governance Index essentially aims to assess how SOEs have implemented good governance practices, which include the main recommendations by the Organization for Economic Cooperation and Development (OECD), the provisions of Resolution No 665 Approving the Schedule of Procedures for the Implementation of State Property and Non-Property Rights in State-Owned Enterprises (Ownership Guidelines) and of Resolution No 1052 Approving the Guidelines for Ensuring Transparency of State-Owned Enterprises (Transparency Guidelines), and other documents governing the SOE activities. Currently, the SOE Good Corporate Governance Index is the only tool that facilitates the evaluation of the quality of SOE governance.

Reports on MOE activities

Back in 2013, the Governance Coordination Centre prepared the annual report on the municipality-owned enterprise (MOE) activities 2012. After six years the preparation of MOE annual report has been renewed. Since year 2019 the reports are being prepared each year. We are proud to present yearly MOE activity reports that will enable to get to know Lithuania‘s municipality-owned businesses’ activity better.
